CONDITIONS OF THE AUCTION: The Seller does warrant a good and marketable title to the real estate and will convey the same with a general warranty deed, free and clear of any and all encumbrances, judgments, or liens. ALL PROPERTIES ARE BEING SOLD “AS IS”.
AUCTION ORDER:
First, we will offer the choice of Tracts 3-36 by the dollar. The high bidder has the choice and privilege to take one or more of these tracts at the time of bidding.
Second, we will offer any requested combination of tracts 3-36. Previous adjoining tracts to the same bidder will not be split. A 5% bid increase of the previous bids is required to bid on the property in this manner

RESERVATIONS AND RESTRICTIONS: We are selling subject to all rules and regulations of any appropriated authority having jurisdiction over the subject property.
We are selling subject to all utilities and right-of-way easements either recorded or unrecorded.
We are selling subject to the Covenants, Restrictions, Reservations for The Retreat on Terrapin Creek which have been made available and that will be recorded in the Cherokee County Alabama Probate Office.
SURVEY FEES: We are selling from a preliminary plat performed by Land Pro, LLC. Swafford Auction Group, LLC nor the Seller assume any responsibility for any survey work performed or any property lines. All survey fees are due and payable by the purchaser today on all tracts and are non-refundable.
The survey fee is $750.00 per tract.
DEVELOPMENT FEE: The development fee is $4,750.00 on each individual tract. This cost is for the paved county road, electricity, county water, and individual perc tests for each lot.
OWNER FINANCING TERMS: 20% down due at closing. Balance will be financed at 8% interest on a 20-year amortization schedule with a 5-year balloon payment and no pre-payment penalty.
CLOSING ATTORNEY/LOCATION: The closing will be held at the law office of Buttram, Hawkins, and Hopper LLC located at 270 E Main St, Centre, AL 35960 (256) 927-5764.
CLOSING COST: The Sellers will provide a warranty deed at closing, ANY and ALL other closing costs incurred, including but not limited to title search, title insurance, recording fees, and closing fees will be at the purchaser’s expense.
TAXES: The 2026 Property Tax will be prorated to the date of closing.
TERMS: There is a 10% buyer’s premium on the real estate that will be added to the purchaser's bid to arrive at the final bid price. The 10% buyer’s premium is required today on the real estate and will serve as the deposit. The deposit will be held in escrow until closing. The remaining balance is due at closing. Closing will be held on or before July 6, 2026.
There is a 11% buyer’s premium on all online bids that will be added to the purchaser's bid to arrive at the final bid price.
CONFIRMATION: The first 25 lots will sell ABSOLUTE to the highest bidder regardless of price. After these 25 lots are sold, the Seller reserves the right, at their discretion, to continue the auction.
Once a lot is confirmed, the high bidder will enter into an Auction Sales Contract for the real estate and will be responsible for carrying out their obligations set forth in the contract and the Terms and Conditions of the contract.
BUYERS NOTE: Prior to the auction, all prospective purchasers should examine the property and all surrounding documentation carefully as each bidder is responsible for evaluating the property and shall not rely on the Seller or the Auctioneers. Seller and Auctioneers are assuming that the bidders have inspected the property and are satisfied and accept them “AS, IS” without any warranties expressed or implied. Personal on-site inspection of the property is recommended.
The failure of any bidder to inspect or to be fully informed as to the condition of all or any portion of the property offered will not constitute grounds for any claim or demand for adjustment or withdrawal of a bid, offer, or deposit money after its opening tender. This sale is not contingent on a potential buyer’s ability to obtain financing.
