     We are privileged to offer at public auction these 14 +/- acres of waterfront building lots, waterfront recreational lots, and water-view lots. This property is being sold ABSOLUTE to the highest bidder for the Circuit Court of Cherokee County, AL (Case No.: CV-2016-900099.00)

The waterfront building lots are restricted to site-built homes only containing a minimum of 1,400 square feet of heated area. The water-view building lots are restricted to site-built homes only containing a minimum of 1,000 square feet of heated area. No mobile or modular homes are allowed on the tracts.

Auction Site: On location at end of County Road 367, Leesburg, AL 35983

Directions to Auction Site: From Leesburg at the intersection of AL Hwy 68 and US Hwy 411, take AL Hwy 68 toward Collinsville for 1 mile to AL Hwy 273 and turn right, go 3.2 miles to County Road 367 and turn right, County Road 367 dead ends to the property on the left. Auction signs are posted.

Preview: Preview property at any time. You may also contact our office to have an auction representative meet you at the property or to preview the houseboat. There will also be a preview on Friday, April 26th from 9 AM until 3 PM for all items and property. 

Registration: You may register at the preview on Friday, April 26th or registration will begin 1 hour prior to auction start time on sale day. All interested persons must register to bid prior to bidding.

Terms:  There is a 10% Buyer’s Premium on the Real Estate that will be added to Purchaser’s bid to arrive at the final bid price. The ten percent (10%) Buyer's Premium is due on the day of auction for the Real Estate and will serve as the deposit. The deposit will be held in escrow until closing. Balance due at closing. Closing will be held on or before May 27th, 2019. This sale is not contingent on a potential buyer’s ability to obtain financing.

There is a 10 % Buyer’s Premium on all personal property that will be added to Purchaser’s bid to arrive at the final bid price. All applicable sale taxes will be charged unless buyer has Tax Exempt status.

All personal property items are to be PAID in FULL on the day of auction and prior to removal. This includes the 1996 Stardust Houseboat. 

All property is being offered "AS IS" without any warranties, guarantees, or promises.

Restrictions:  The waterfront building lots (Lots 1, 2 & 4) are restricted to one site-built home only per lot containing a minimum of 1,400 square feet of heated area. The water-view building lots (Lots 3, 5-17, 24 & 25) are restricted to one site-built home only per lot containing a minimum of 1,000 square feet of heated area. No mobile or modular homes are allowed on any lots.

The recreational lots (Lots 18-23) are restricted to only one camper, RV, or Alabama Power approved elevated structure per lot.

Any shoreline development on any waterfront lot (building or recreational) must obtain approval by the Alabama Power Shoreline Management office. 

Survey/Development Fee: The survey/development fee on Lots 1-5, 16 & 17 is $1,350 per lot. (These lots will require an engineered septic system due to slope regulations from the Cherokee County Health Department).  

 

The survey/development fee on Lots 6-15 is $1,850 per lot.

The survey/development fee on Lots 24 & 25 is $1,000 per lot.

 

The survey/ development fee on Lots 18-23 is $400 per lot.

The survey/development fee is due and payable by the purchaser on the day of the auction on all lots. 

Concessions: Free BBQ will be served at this auction.
